PEKIN, Ill. – The Washington man accused of shooting at police and causing a house explosion on Mother’s Day morning has volunteered to stay in jail.

39-year-old Scott Benway was back in court on Wednesday, where he conceded pre-trial detention without prejudice or findings.

The hearing came a day after Benway’s first court appearance, where a decision over his detention was delayed due to Benway not being medically cleared to wear a GPS ankle monitor.

At first, prosecutors were okay with Benway being under the care of his mother under a strict set of restrictions.  But hours after the hearing, prosecutors changed their minds and wanted Benway detained.

An arraignment hearing for Benway is still scheduled for June 4th.
